26 Sep Brown White & Osborn Defeats Motion to Dismiss on Behalf of Manhattan Beach Firefighters in Key First Amendment Case
Today, United States District Court Judge Hernan Vera ruled in favor of BWO’s clients, twelve Manhattan Beach Firefighters and the Manhattan Beach Firefighters Association, and denied the City of Manhattan Beach’s motion to dismiss. BWO’’s clients sued the City of Manhattan Beach under section 1983 for violating their civil rights. Their complaint details a long history of retaliation from the city against them for calling out incompetence and mismanagement of the city’s fire department. Government retaliation against public employees for exercising their right to free speech is anathema to the First Amendment, which today’s ruling rightly helped safeguard.
