  • Defended food manufacturer in action with natural gas supplier over the termination of a natural gas contract; and action filed by factor of shipping transporter to recover accounts receivable.
  • Defended automobile manufacturer and related entities in a breach of contract action arising from a racing supply agreement; a fraud action stemming from an alleged “bait and switch” advertisement by one of its dealers; and an antitrust, false advertising and unfair competition action asserted by distributor of replacement parts.
  • Defended roof product manufacturer in breach of contract action filed by natural gas supplier over the termination of a natural gas contract.
  • Represented construction and engineering contractor regarding claims asserted in Enron bankruptcy, and issues involving right to arbitrate pursuant to gas supply agreement.

Government Contract Related Matters
  • Represented government subcontractor in action against prime contractor for wrongfully withholding funds for food and other services provided to United States troops in Afghanistan.
  • Defended government subcontractor in supplier’s action for alleged unpaid costs relating to the supply of propulsion systems for amphibious United States Army vehicles.
  • Defended refuse contractor in two false claim actions filed under the California False Claims Act, including representation on appeal.
  • Represented government contractor in claims against the United States Air Force for additional job costs and other damages incurred with respect to the installation of underground oil/water separator tanks at Hickam Air Force Base in Hawaii.
Environmental Matters
  • Defended company in RCRA and CERCLA action to recover costs associated with soil contamination at client’s plating facility.
  • Represented buyer in environmental indemnity action against seller of numerous can-manufacturing facilities throughout the county due to soil and groundwater contamination at various sites.
  • Represented real property owner in action against remediation contractor for contractor’s failure to properly design and construct a vapor extraction system for the removal of VOCs at former manufacturing site.
  • Defended former owners and operators of real property in CERCLA action for recovery of costs and other claims arising from soil and groundwater contamination of TCE and PCE at former manufacturing site.
Miscellaneous Representation
  • Provide clients with general legal representation and counseling regarding commercial, business and employment matters; assist clients in minimizing potential legal exposure; negotiate and prepare various business and commercial agreements.
  • Represented shareholders of debtor in bankruptcy litigation, including successful transfer of venue of action from Minnesota.
  • Represented defense contractors in successfully opposing motion for class certification in action for alleged exposure to toxic.
  • Defended manufacturer of agricultural products in action arising from special employee’s severe personal injury sustained while operating fertilizer blender.
  • Represented pesticide manufacturers in the prosecution of consolidated state court cases against state agency for the unlawful use of clients’ pesticide health and safety data to support applications for generic pesticide products submitted by other companies.
Mediation Practice

Mr. Menard began his mediation practice in 2008. Since then, Mr. Menard has mediated hundreds of cases involving business, commercial, real estate, employment, partnership, unfair competition, infringement and personal injury matters. In addition to his private mediation practice, Mr. Menard offers his services as a panelist for the California Association of Realtors and the United States District Court, Central District of California.

Mr. Menard is certified by the Los Angeles County Bar Association to conduct mediations, and is a former panelist of the now defunct Los Angeles Superior Court’s Alternative Dispute Resolution Program. Mr. Menard is a member of the Southern California Mediation Association (SCMA), and has participated in numerous mediation training courses and seminars, including the basic and advanced mediation training programs offered by the Los Angeles County Bar Association, and programs presented by the SCMA, the Straus Institute for Dispute Resolution at Pepperdine University School of Law, the USC Gould School of Law, and the United States District Court.
